The Platform has been structured in ways suitable to encourage the online sale of goods and/or services (MarketPlace).

On the site users can make purchases of products and/or services promoted for sale by authorized sellers to access the site.


1. General Conditions of Use

The WebMarco Marketplace, accessible via the URL: https://webmarco.com/ provides you with site functionality and other products and services when you visit or shop. Browsing and transmitting a purchase order on the site implies acceptance of the Conditions and Data Protection Policies (Privacy) adopted by the site indicated therein. We invite you to read our Privacy Policy, to understand how we collect and process your data through the WebMarco Marketplace. These General Conditions of Sale apply to the sale of goods and the provision of services with exclusive reference to purchases made on the site by the provisions of the Legislative Decree no. 21/14 and Legislative Decree 70/03 by the Company: WebMarco SRL

You are required to read these General Conditions of Sale before accessing the products and services provided by the site, which are generally and unequivocally accepted at the time of registration. We invite you to download and print a copy of these General Conditions of Sale, the terms of which WebMarco reserves the right to modify unilaterally and without prior notice to offer new products or services or to comply with legal and regulatory provisions. If any provision of these conditions is deemed invalid, null, or for any reason unenforceable, this condition will in any case not affect the validity and effectiveness of the other provisions.

These General Conditions of Sale govern the offer, forwarding, and acceptance of purchase orders for goods and services on WebMarco, and do not, however, regulate the provision of services or the sale of products by parties other than seller who are present on the same site through links, banners or other hypertext links.


2. Sale conditions

These general conditions of sale govern the sale of products, where applicable, of services through the website www.webmarco.com. We offer a wide range of Marketplace Services and you sometimes may be subject to additional terms and conditions. If you use any WebMarco Marketplace Service.

We invite you to carefully read these Terms of Sales carefully before proceeding with any purchase. By making any purchase, you fully accept these General Conditions of Sale.

2.1  These General Conditions of Sale govern the offer and sale of the products/services promoted on the Site.

2.2  These Conditions of sale apply to all sales of the Products/Services made through the Site. They can be modified at any time to be effective from the date of publication, for contracts subsequently concluded. Any changes will be effective from the moment of their publication on the Site. Users are therefore invited to check them before making purchases.

2.3  The applicable Conditions of Sale are those in force on the date the purchase order for the product/ service is sent.

2.4  These Conditions of Sale govern all product sales concluded on the Site through links, banners, or other hypertext links. The platform operator will supervise the regular supply of services and/or for the sale of products by these subjects, assuming all responsibility exclusively towards each buyer.

2.5   These Conditions of Sale govern all sales of products and/or services operated on the Site. Platform Manager, while fulfilling the roles of technical manager of the platform and seller, in relation to those sales contracts made on the platform between buyers with third-party sellers guarantees the supply of services and/or sales of products promoted for sale by Third Party Sellers, and will remain the subject with which buyers will have to interface for:

·         The Logistics Service, which will be performed at the impulse of the Platform Manager until the delivery to the courier of the products sold;

·         The telephone or e-mail assistance service to the customers of the MarketPlace which will be carried out by the Platform Manager;

·         The service for the management of legal and contractual guarantees that will be carried out by the Platform Manager

·         Match the payment of supplies.


3. Copyright

All content present or made available through the WebMarco Marketplace Services, in the form of texts, graphics, logos, icon buttons, images, audio files, digital downloads, data collections, and software, they are the property of WebMarco or its vendors, they are protected by international laws of copyright, author, and database rights. The list of all the contents presents or made available through WebMarco Marketplace Services is the exclusive property of WebMarco and is protected by international copyright and database rights laws.


4. Mode of communication

When you use WebMarco Services or send us e-mails, text messages (SMS), and other communications from your computer or mobile device, you communicate with us in electronic form. We may communicate with you in various ways, such as via e-mail, text message (SMS), in-app notifications, or by posting messages and communications on the site or through other WebMarco Marketplace Services. The information and other communications that we provide to you in electronic form satisfy the requirement of the written form, when required by law.


5. Registered users

Registration on the Site is free. To register on the Site, the user must fill in the appropriate form:

- Entering name, surname, mobile phone number, e-mail address, password, and click on the "Create" button.

- In the mobile number you will receive an OTP code with 4 digits.

- Accept the processing of personal data and click on the "Verify" button.

- Once the code has been verified, your account will be created.

By registering on the Site allows the user to access the reserved area for:

- Log in at any time and check the status of your orders.

- Make it easier for future purchases.

After completing the registration procedures, you are obliged to follow the instructions on the site and provide your data correctly and truthfully.  It obliges you to promptly inform WebMarco of any variation of your data at any time communicated. If it then communicates to us inaccurate or incomplete data or even if there is a dispute by the interested parties about the payments made, WebMarco will have the right not to activate or suspend the service until further information is proven true to date. On the occasion of the first request to activate a profile, WebMarco will assign you a username and password. You are required to maintain the confidentiality of your access data and to keep them with due care and diligence and not transfer them, even temporarily, to third parties. You undertake all necessary precautions to ensure that your password remains secure and confidential and you undertake to notify us immediately if you have reason to believe that any third party knows your password, or if your password is, or is presumably about to be, used in an unauthorized manner. We reserve the right to prevent access to the site, to suspend or close an account, to remove or modify the contents of the site at our discretion, when found in violation of the applicable legal provisions, and general conditions of sales.


6. Product Information

Each Product on the product pahe is detailed in description, images and characteristic features. Images may differ in size or relation to any acessory product. These products complete the conditions of sales and are true to date by information given by vendors.

6.1 Prices

6.1.1  All prices of the Products depend on the currency that the Vendor choose. Delivery costs may change to the payment method used, which will be specifically indicated during the purchase process, before the user is bound by the contract, in the order summary, and in the order confirmation e-mail.

6.1.2  The Vendors reserves the right to change the price of the Products at any time and also, possibly, several times during the same day. It is understood that the price of the Product that will be charged to the user will be the one indicated in the order summary, displayed by the user before placing the order and that any changes (increase or decrease) after the transmission of the order itself.If a Product is offered on the Site at a discounted price, on the Site will be indicated:

(I) the full reference price against which the discount is calculated.


6.2 Availability of Products

6.2.1 The Products that can be purchased through the Site are the items in the electronic catalog published on the Site and viewed by the user at the time of the execution of the order, as well as the products in the electronic catalog published on the Site at the time the order is placed. The products are offered divided into categories.

6.2.2 Each Product is accompanied by an information page that illustrates its main characteristics. On the Product Page will be a special section containing information about the availability of the Product. If a Product is not available, the user can contact the Vendor to further be notified of the availability of products( re-stock).

6.2.3 The availability of products is monitored and updated in real time. However in case of multiple purchases of the same products, it is possible that out of stock products are not updated.

6.2.4 If the Product is no longer available for the reasons indicated above or for any case of unavailability of the Product, the proposing seller will promptly notify the user by e-mail and the contract may be freely and discretionally terminated both by the proposing seller and by the would-be buyer.

6.2.5 If the user makes use of the right of termination, the Platform Manager will refund the Total Amount Due without undue delay and, in any case, within 10 working days from the day of termination. The refund will be done by using the methods indicated below.

 

7. Purchase Orders

The purchase contract is subject to the payment of the Total Amount. If this payment does not take place, the contract will therefore be considered terminated by law.

The ownership of the Products will be transferred to the user at the time of shipment, to be understood as the moment of delivery of the Product to the carrier ('' Shipping '').

7.1 Payment methods

7.1.1 Orders can be paid by credit card and bank transfer and COD.

Remember that the data for issuing the invoice must coincide with those entered in the billing address.

7.1.2 Credit Card

You can use your Mastercard, Visa, Post-pay, American Express, Discover and Diners Club credit card, and all major credit and prepaid cards. Your card will be charged immediately.

7.1.3 Refund. If you return one or more items of your order, the corresponding amount will be credited to the card or bank account associated with it.

7.1.4 Security. Your card details are processed through the SSL security system. At the time of the conclusion of the order, the 3DS authentication procedure will be used and you will be redirected to your bank's web page. To complete the order, follow the required steps.

7.1.5 Bank Transfer. Payment for Products purchased on the Site can be made by bank transfer. The bank details for making the transfer will be indicated on the "Payments" page accessible via the appropriate link from the footer of each page of the Site and in the order confirmation e-mail. Payment for the Products by bank transfer must take place within five days, after which the contract will be terminated. In the case of payment by bank transfer, the Shipment of the Products will be carried out only after receipt of the payment and the terms for processing the order will be effective from that date.

7.2   Methods, costs and terms of delivery

7.2.1 The deliveries of the Products are made all over the world. Each product will have specified where it can be sent and for how long.

7.2.2 At shipment time, to the user will be sent an e-mail confirming delivery to the carrier which will contain the tracking number, through which the user can check the status of the shipment; the user can still follow the tracking of the shipment of the Products from the "Status and order tracking" section of their account.

7.2.3 In the order summary, the total price of the order will be indicated, with delivery or separate costs. This total, which will also be indicated to the user in the order confirmation e-mail, will constitute the total amount due by the user concerning the Product.

7.3   Return and Refund

7.3.1 If you have made a return, the refund will be done within ten working days from the date of receipt of the package. When we receive your return, we will send you a confirmation email.

7.3.2 If an item received is broken, you can proceed with a claim.

7.3.3 The return must always have the original box and invoice. If a product is broken you must make a complaint to the seller to get all the information on how to proceed with this product.

 

8. Conventional Manufacturer's Guarantee

The sold products on the Site may, depending on their nature, be covered by a guarantee contractually issued by the manufacturer/seller ('' Conventional Warranty '' or "Contractual"). The user can only enforce this guarantee against the manufacturer. The duration, the extension, even territorial, the conditions and methods of use, the types of damage/defects covered, and any limitations of the Conventional Guarantee depend on each manufacturer and are indicated in the so-called guarantee certificate contained in the product packaging.

The Conventional Guarantee is voluntary and does not replace, limit, prejudice or exclude the Legal Guarantee.

 

9. Marketing of Additional Paid Assistance Services

9.1   The platform operator, in collaboration with third-party companies, offers the user the possibility to purchase additional assistance services (''Additional Assistance Services'') that allow the user to take advantage of an additional warranty period, following the expiry of the Legal Guarantee and/or the Conventional Guarantee, under the conditions and with the limitations outlined in the relative general conditions that will be made available to the user before he can purchase the Additional Assistance Services. The Additional Assistance Services do not replace, limit and do not prejudice or exclude the Legal Guarantee due by the Platform Manager, which the buyer can use, under the contractual conditions. Additional Assistance Services are provided by the Platform Manager in the manner recognized in the appropriate section of the sales site.

9.2   The purchase of Additional Assistance Services is for consideration and therefore requires the payment of a cost to be paid by the user. This cost and any other information on how to activate them will be provided during the purchase process before the user can proceed with the purchase of mentioned above service.

9.3   In all cases of termination, for any reason, including the exercise of the right of withdrawal, of the purchase agreement for the Product about which the user has purchased the Additional Assistance Services, the purchase agreement for these services is resolved by law, without costs for the consumer and with a consequent return to the user of the amount paid by the same for the purchase of Additional Assistance Services.

 

10. Minors

We do not sell products to minors. If you are under the age of 18, you can use WebMarco Services only with the involvement of a parent or tutor.

11. Privacy

You are required to review our Privacy Policy to understand our practices.

12. Transactions Between Buyers and Sellers

14.1 Through the Sites, WebMarco provides digital platforms for exchanging information between buyers and sellers of products and services. For any Product/Services WebMarco does not represent either the seller or the buyer in specific transactions. WebMarco does not control and is not liable or responsible for the quality, safety, lawfulness or availability of the products or services offered for sale on the Sites, the ability of the sellers to complete a sale or the ability of buyers to complete a purchase.

14.2 Users are hereby made aware that there may be risks of dealing with people acting under false pretenses. WebMarco uses several techniques to verify the accuracy of certain information our paying Users provide us when they register for a paying membership service on the Sites.  However, because user verification on the Internet is difficult, WebMarco cannot and does not confirm each User's purported identity. We encourage you to use various means, as well as common sense, to evaluate with whom you are dealing. 

14.3 Buyers and sellers accessing or using the Sites or Services shall assume the risks of conducting any purchase and sale transactions in connection with or through the Sites or Services. Buyer and sellers accessing or using the Site or Services shall also fully assume all risks of liability or harm of any kind arising out of or in connection with any subsequent activity relating to the products or services that are the subject of the transactions on the Sites.

13. Reviews, Comments, Communications, And Other Content

You may post reviews, comments, photos, videos, and other content or other form  of communication; and submit suggestions, ideas, comments, questions, or other information, so long as the content is not illegal, threatening, defamatory, invasive of privacy, infringing of intellectual property rights (including publicity rights), or otherwise injurious to third parties or objectionable, and does not consist of or contain software viruses, political campaigning, commercial solicitation, chain letters, mass mailings, or any form of "spam" or unsolicited commercial electronic messages. You may not use a false e-mail address, impersonate any person or entity, or otherwise mislead as to the origin of a card or other content. WebMarco reserves the right to remove or edit such content, but does not regularly review posted content.

 

14. Disclaimer of Warranties and Limitation of Liability

WebMarco services and all information, content, materials, products and other services included on or otherwise made available to you through our services are provided by us unless otherwise specified in writing. WebMarco makes no representations or warranties of any kind, express or implied, as to the operation of the services, or the information, content, materials, products (including software) or other services included on or otherwise made available to you through the WebMarco services. You expressly agree that your use of the WebMarco services is at your sole risk.

To the full extent permissible by law, WebMarco disclaims all warranties, express or implied, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose. WebMarco does not warrant that the services, information, content, materials, products or other services included on or otherwise made available to you through the services, WebMarco's servers or electronic communications sent from WebMarco are free of viruses or other harmful components. To the full extent permissible by law, we will not be liable for any damages of any kind arising from the use of any service, or from any information, content, materials, products or other services included on or otherwise made available to you through any service, including, but not limited to direct, indirect, incidental, punitive, and consequential damages, unless otherwise specified in writing.
